# amazon say
(via email to UK journalist who then forwarded to us)

'We can confirm that there was a price discrepancy on the site for HP iPAQ
Pocket PCs this morning. Despite our best efforts, with the millions of
items available on our website, unfortunately pricing errors can occur.

'In keeping with our Conditions of use and our Pricing and Availability
Policy, we will be cancelling orders made for the HP iPAQ Pocket PCs at the
incorrect price this morning. In our Pricing and Availability Policy, we
state that where an item's correct price is higher than our stated price,
we contact the customer before dispatching. Accordingly, customers will be
contacted and offered the opportunity either to cancel their order or to
place new orders for the item at the correct price. As the Conditions of
Use clearly state, there is no contract between Amazon.co.uk and the
customer for an item until Amazon.co.uk accepts the customer order by
e-mail confirming that it has dispatched the item. Until that time,
Amazon.co.uk is within its rights to not accept any customer order.

'No customer credit card has been charged for orders made this morning at
the incorrect price, as we do not charge a customer's credit card until the
order has entered the dispatch process.'

Translation: 'We're not giving away loads of stuff. Fuck off.'

if it was a price label in a real shop, but I believe that this is not the case in an electronic virtual shop thing on the interweb
(, Wed 19 Mar 2003, 16:55, archived)
# Not even then. This is what "Publishing Law" has to say:
"Does a bookshop make an offer when it displays a book in the window at a certain price? Suppose the price label is out of date: can a customer 'accept' the offer and claim there is a binding contract at the old price? No - because shops in those circumstances are not making binding offers, but merely offers to come in and enter negotiations - what the law calls 'offers to treat'. So if our canny customer takes the book to the till and offers the old price, it is then open to the bookseller to reject that offer and instead make a counter-offer to sell it at the correct price."

# Contract
If they had taken the money from the customers ordering then that constitutes a formal contract and Amazon must honour it.
Because they hadn't taken the money...
Well that's how I see it, I think the Argos situation was different as cash was taken from credit cards and so the contract was binding.

My First message.....is this supposed to be a momentus occassion? Am I supposed to post something fun for all the world to be amused at? I got nothing to say, im bored, tired, annoyed and just want to win a large sum of money and be sorted for the rest of my life!

oh now I have something to say...

"Money doesn't buy hapiness"

What are your opinions on the above?

Personally i think yes, you need money to be truly happy, cos what the fuck can you do without money, you can have sex (unprotected cos condoms/pills cost money) you can knock cocunuts down from the veiney palm tree of love. (but its not the same) Also you really can't live without money, inless your living in a tribe in the Amazon rainforests or something, but still then, someone like me or you isn't going to be happy doing that.

My bet is it was some rich prick who wanted to keep his social class high and mighty.

Ah, but if you were living in an Amazon Tribe you'd not be too worried about scheduling meetings and storing peoples e-mail and postal addresses now would you.

And besides, where do you keep your life's savings of 7 British pounds when you wear a Loincloth? (that's a rhetorical question!!!)

when this happens again, and it will, find some stupid website that will pice match a product...they simply look at the site (see it's price and availability) and Bingo!! legit cheap stuff!!!

Or mayeb they'd make up some legal mumbo jumbo to fleece us again!!!

So they've covered there arses?! They could take everyone out in all likelyhood, and seeings as they've made a pretty pisspoor job of a statement then id be inclined to argue, but the last time i argued with Amazon.. they took away my wife and kids sniff sniff

# ** Amazon Fucks you over (the consumer) yet again!!!
So as usual Amazon say the buyer doesnt have a contract until the goods have dispatched..

Hmmm then what the fuck are they talking about when they confirm the order?
(see below)

Your right to cancel:

So if this isnt a contract then I dont know what the fuck is nowerdays!!!!

Amazon ante up you miserable fucks!!!!
yet again when the shit hits the fan they hide behind their T&C's quoting capter and verse!!

(and they have made a load of pricing errors in the past - just search on google - and you could say they are guilty of a bait-and-switch tactics - after all if you signed up/gave your details etc.. they now have your details on their system whcih they could probably sell onwards and then you get shit loads of spam through the post or on your email..))

This is not the first time this has happened - you'd think they would have learned and sorted it out.. but NOoooooo... !!!

It's not as if I bought 50+ of the product - I just bought 1 of each.. for me and my partner..

Amazon should honour the smaller purchases but disgard the bulk purchases..

# Amazon
As far as I know, legally
1. Amazon made an offer at a price
2. The offer was accepted and an order placed
3. Amazon accepted the order.

Anyone who has any proof of Amazon accepting the order (i.e. an email or printscreen) probably has a very good legal case. Maybe all of you should form a "group action" and take them on
