Nope, it's a high court ruling in the UK. 6 ISPs must block it, I can't remember which ones.

I think the fact it's a court order would kind of be what makes it stand up in court.
but, yeah. That might be used as a defence. but I reckon the 5 will just do it, no real skin off their nose.
