# Actually it went the other way
The original evaluation judged him to be insane. People were very unhappy with the assessment - there were a few things happening that may not have been strictly a breach of protocol but were clearly non-desirable - and so there was a second assessment recently. That assessment judged that he is not insane now, and more importantly that he was not insane at the time of the attacks.

I'm not sure which would be better, to be honest. If he were judged insane he couldn't stand trial and would instead be locked in a secure asylum for life - which would be quite a punishment for him, but would give the impression that no justice will be served. This way he can be put properly in jail (from which he will never emerge - and I wouldn't be at all surprised to learn in a year or two that he 'committed suicide' in jail), but it gives him a platform. And it's a platform he's *already* using, and the media across Europe are giving it to him.
