Surely it is Play's fault, because all he's done is to create an image for his own site. If they happen to use that image without permission then the moral rights are surely his?

It is, but this is rather the Web equivalent of "I'm going to swing my arms in a circle and walk forward like so, and if you get a smack in the eye it's your own fault, eh!"
