Free-climbing is fairly common, but if you get caught doing it you tend to get your arse thrown off site. Dunno about over there (think it's Canada).
And yep - the tower does move around a fair bit at the top, definitely not unusual to feel it sway two to three meters in all directions.
(EDIT : two to three for guyed masts, one meter for solid structures!)

in fact, the video is from the US, hence the mention of OSHA (the US "Occupational Safety and Health Administration"). I can't figure out what tower it is based on the height.
