Even though he was causing an obstruction he may argue he was in car and able to move at any time if requested

You made an error of judgement and collided with a stationary vehicle.

His insurance company will argue that as he was in the car you should have requested he move his vehicle before proceding.

Tough cookies but thats life. I have even seen buffoons stopping on roundabouts to answer phones!!!
