do that. It's tantamount to stealing someone's business name if they are a few days late getting their sign repainted.
You can back order a domain with some firms and they will register it on your behalf if and when it becomes available. If you really want the domain then backorder it with all the big domain name registry firms ( like godaddy etc )

I don't think a domain becomes available immediately on expiry. I think it becomes available after deletion which is a couple of months after expiry.)
