No, they an established legal fact.
They existed long before farmer twat decided to obstruct them and a lot of them will exist after farmer twat has died and his offspring have sold the farm to property developers for a housing estate.

Rights of way predate the 2000 act by a few hundred years.
Walk around any old town and you'll notice them -- sometimes splitting buildings in the most incongruous ways.
