That's not how the courts interpret it now.They consider all sorts of things; what assets each had prior to the marriage, joint assets acquired during the marriage, the length of the marriage (and the length of time spent cohabiting before the marriage), earning capability of each person, what the lower earning partner needs to live on etc.
