normally the definition of 'driving' is being in control of a car with the engine running, so in this case it'd be arguable.

But as the car is effectively sitting in traffic, not parked, there'd still be a strong argument that the phone can't be used.

I doubt a copper would give a ticket for that, and the PCSO was just willy waving, but if a copper DID give a ticket, there's pretty much no chance he'd get it squashed.

You have to bear in mind the law / police do not like people using their phones in cars, and will as far as possible wallop people for doing it.

I seem to remember an acquaintance of mine getting done for drink driving whilst pushing his motorbike home.
The coppers had watched him leave the pub, and approach the bike, so could have just told him to leave it, too.

Massive booze up going on in a hotel bar in Switzerland, cops turn up asking who owns the red Mini parked out front.

Driver identifies himself, apologises for the technicality he'd breached but refuses to move the car saying he's had a few boozes. Cops insist. Driver holds firm. Cops threaten arrest. Driver relents, gets in, key in ignition... Cops arrest him for drink driving.

You can be drunk in charge even if the engine is switched off and the key is out of the ignition. If the engine is running you'll definitely be convicted. But any other circumstances where you're pissed and could reasonably be suspected of intending to drive you'll still get done.
