We already do adapt for individual circumstances in terms of sentencing,
as it happens.
Again, I don't think he was saying that we must adapt for individual circumstances... I think he was saying that the lack of adaptation is a flaw, without suggesting any practical correction for that flaw.
I would agree with him, it's flawed but what else can the law do?
