It's perfectly obvious what does and doesn't constitute driving in the middle lane unecessarily
it's simply a mild form of driving without due care and attention. No traffice policeman is going to be pulling someone over on the M25 between the hours of 6am and 8am or between 4pm and 6pm, but outside of those times, there are plenty of places where there is always a queue of cars in the 3rd lane who should be in the 1st lane.

But if you pull one of them over they will bitch and moan about why you didn't stop the other drivers.
