They broke the law and refused to do anything about it
to the point that now they're up against eviction. If they're willing to comply with the law, then give them the time to do so. If not, kick them out.

In the intervening years, 2005 I think, the settlement was
declared legal and within planning laws. Then reversed.

Then I think that where the options are "split up a community" or "annoy some local nimbys"
I'd say honour the original planning decision.

Bit late for that.
Shift them after a short period if you can but unfortunately the legal process doesn't really allow for that.
