"A brother-in-law is one's sibling's husband, one's spouse's brother, or one's spouse's sibling's husband."

Now the two non incestuous options have already been put forward (i.e. he hasn't just become your wives actual brother) so I again think you have got it wrong and he isn't actually your brother in law.
