Can I ask a "what are my rights" question?
We bought a fridge freezer from ebay and paid £80 delivery. It arrived yesterday and I let it stand. I've plugged it in and it trips the circuit breaker. I've checked the obvious stuff like plug, fuse and checked for damp. My electrician friend said sounds like and earthing problem so its probably fucked. Ebay guy claims to give a short guarantee which is extended to a 12 month guarantee if positive feedback is given (is this even legal). It was a brand new graded item. Still packaged but with a small dent in side. Sold as fully tested and working. Now guy is saying we have to send it back at our own cost which we just can't afford to do. We are saying he should arrange collection as he sold us a fucked freezer. Is there anything we can do?

I'd suggest checking on ebay
and also paypal (I assume that was how you paid).

I believe someone here posted something about rights on buying from places like this - basically it's more or less similar to buying from a shop, and you should be covered for returns and refunds, IIRC.

He's a registered business though so I am presuming if its fucked it should be sorted at no cost to me.

Trading Standards.
Remember that you contact the office where he is and not your local one.

Distance selling regulations
It fucks the seller every single time. Check up on it, its a doozey. Just quote it in full & verbatim, they dont have a leg to stand on.

The distance selling regulations are good for this sort of thing
But if you want to be sure of getting results from a dodgy small business* start your email "I asked my uncle who is a tax inspector and he says..."

It's mean but it works!

*I know not all small businesses are dodgy, many are lovely (including mine)

Hm he seems to think Distance selling regulations don't cover auctions
is this true?

Anyways I've kinda of got it working, I'm going to give it a day and if its all working properly I may leave it.
