Due to a postal strike the letter didn't reach me within 14 days of the offence and I wrote a letter pointing out that this was a failure on their part to abide by the terms of the act. They replied that they only had to send it out within 14 days, a lie that even a layman can spot in a reading of the relevant section of the act. There were a couple more letters, me quoting the relevant parts of the act and them basically ignoring it. Eventually I got a letter that basically said, here's your court date: either try it in front of a judge or take the £60/3 points.
I took the penalty - based on what I've heard I might have been able to call their bluff since often they don't turn up to these sorts of hearings and the case is dismissed, but I didn't want to take the chance of standing up in court and arguing a technicality.
Still feel aggrieved though. And I think I might have got flashed again this morning, the bastards.
Both have been on a 4 lane dual carriageway - 2 lanes each side, wide median strip - so why a 40mph limit? To make money.
