In Britain, at least
Having sex with someone under the age of thirteen is classed as rape, whether or not they are deemed to have 'consented'. It's defined in law, hence "statutory" rape.

While what you say isn't wrong
Statutory rape is actually up to 16 (in the UK). You can still be deemed to have not consented, but the police/courts use more discretion.

I didn't realise it was up to 16
I thought there was a different charge for that. But I'll take the word of someone with a law degree ;)
