surely tbe crime is in the uploading due to breach of the licence?
A download is a licenced agreement with someone who doesn't own the licence, hence no crime on the part of the downloader, right? Or is that just software rather than entertainment content?

The way torrents work is that you're both uploader and downloader at the same time.
