This is a normal post If so, why?
this is other b3tan's and their credit cards; at least offer an explaination
(, Tue 14 Oct 2008, 21:47, Reply)
This is a normal post As far as your legal question goes,
whatever they advertise it at, they have to sell it at. But if worse comes to the worst, you can always return to play free of charge.

This is a normal post That point of law does not apply in this situation surely.
They have advertised it at a certain price, and we have all paid for it at that price.

From the Trading Standards website:

"Offences

If the seller is in business (rather than a private seller), he may have committed a criminal offence if he:

*

sells goods which are unsafe;
*

has given a false description to the goods i.e. a car sold with incorrect mileage (clocked car);
*

gives a false description to the services he is providing e.g. falsely claiming to be a member of a trade association;
*

advertises a misleading price;
*

displays a sign which states 'no refunds'."

This is a normal post I think you are wishful thinking
Read the article - if it didn't work like this, the seller would be offering to enter into a contact with the entire world.
(, Tue 14 Oct 2008, 22:12, Reply)
This is a normal post But there are different rules for sellers
and businesses.

EDIT: Also, the case cited in that is from 1960. That would mean that it would now be superseded by the Sale of Goods Act 1979 (as amended by the Sale & Supply of Goods Act 1994 and the Sale and Supply of Goods to Consumers Regulations 2002). No?

I am not trying to get into a row though, I am not a lawyer, but it seems that would be the case to me?

This is a normal post you aren't a lawyer are you? ;)

This is a normal post Pfft!
Reading through the Trading Standards site, it does seem to explicitly differentiate between a "seller" and a "commercial business".

I did do Law at College, but I don;t remember too much of those years ;)

MAKE THIS STATEMENT LAW! ;D

There is a difference between Acts and Laws, but acts such as the Sales of Good are part of common law also I believe.

This is a normal post that wikipedia entry links to
a BBC article regarding Argos mistakenly advertising a TV for sale at £3 in which it says:

'Argos does not have to sell you a television for £3.

However, if the company accepts your order electronically then there may be a valid contract.

A customer who gave Argos his credit card number received what was called a Unique Order Code. That may be proof of a contract, although Argos said all items were "subject to availability"'

An order number is not visible at present, but it stands to reason they must apply a unique order number to each order..

This is a normal post I ordered.
UK trading law says they should honor it. This happened to another store years ago. They cancelled the orders but then the newspapers pressured them and to avoid bad press they honored them.

(, Tue 14 Oct 2008, 21:50, Reply)
This is a normal post Oh yeah.
As far as I know, they are even bigger than Amazon now, and they are always very cheap, as they are based on Jersey so tax free pretty much. All the prices are inclusive of delivery too.

I have never had a single problem with them ever!

Edit: And in case youre worried it is a dummy site, I just ordered it on the computer downstairs which was got to by typing play.com and searching James Bond.

This is a normal post Exactement.
When that super big Matrix collection came out, I found someone on ebay selling them for a tenner each so I bought 10 of them. I gave a couple to friends, kept one myself, put them back up on ebay a few weeks later when they werent so cheap and made about £150.

This is a normal post ooh a chance to pearoast...
i've never understood the point of buying a 'complete collection' box set of a franchise that isn't yet complete

There was a 'complete collection' before this one that finished with Die Another Day, and there will inevitably be one in a few years to include Quantum Of Solace

Just a nice bit of extra wedge for Sony Pictures it seems

but I will be looking into it in the coming days.

In my opinion, there is no harm in ordering anyway. They do state that they will ask if you want to fulfil the order if they do notice it.

it may be a marketing ploy... They'll cancel the order (or at least give you the optioin to do so or buy it at the full price, as in their t's&c's) but by that point you've registered with Play.

I fell for it - I'm now registered with them, hoping (but not expecting) to receive my £10 bond box set.

This is a normal post I know someone who has just bought 50
Personally I think this is a huge error and trying to remember a couple of units of business law I did 15 years ago combined with a telling clause in their reciept as follows :

Please note: This is an 'open' order and has not been processed by our dispatch department. No contract for the sale of any product will subsist between you and Play.com until Play.com dispatches the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by Play.com of your offer to buy goods from Play.com or a third party supplier that is engaged on your behalf by Play.com (whether or not you receive that e-mail).

I dont think they are legally bound to give us anything. However in the interests of not looking like complete asreholes, they may well honour their orders for whatever their stock levels were and take the loss on it.
