If someone online threatens to kill someone else or threatens to kill a gay person are those situations so different?

I think nearly all crime goes up a level on the scale if the motive was linked to discrimination.

If you get in a few fights in pubs over a period no serious injurys etc, you might get a fine or some community service, if you go out and find gay people/black people/jewish people and punch them once in the face the crime is the same but the motive is much more sinister.
