you may not have to use that language, but being that he is being a cunt and you all think so, I think just point this out to him, being rude, or not as you choose and get on with agreeing things between the 4 of you. you have a majority so just ignore the fucker. basically disenfranchise him until he chooses to joint in and do his bit.

It may depend if you want revenge of for him to do his bit. if the former, exclude him from all decisions, then proceed to use his lweast favoutite pain colour, remove cycle racks and buy barbeques allround. if the latter, solicitors letter is probably the way to go and should be fairly cheap.

if he isn't part of the freeholder, provided he complies with the terms of his lease, then he IS complying with his legal responsibilities. there'd need to be something in his lease obliging him to do this kind of thing. if there is, then the freeholder is the only person who can make him do it. via the courts if he refuses.
i'm not saying he isn't an anti-social cunt.

Which as I understand it allows the RA to get work done without having to involve the freeholder (who would charge a fee to manage it).
The articles place equal responsibility on all residents to play an active role in the management of the maintenance of the building, in addition to paying their contribution.
