just tell him he's being a cunt.
you may not have to use that language, but being that he is being a cunt and you all think so, I think just point this out to him, being rude, or not as you choose and get on with agreeing things between the 4 of you. you have a majority so just ignore the fucker. basically disenfranchise him until he chooses to joint in and do his bit.

He does pay, but he won't do anything to help out with getting any of the work done.

Just a thought, if it was me there really is nothing of practical value I could add to any maintenance work.
These are not workman's hands right here.

You could arrange for quotations to be done, be around on occasion to let tradesmen in to the building, manage the money etc.

Oh yeah, that sort of shit is easy.
Especially if you've got other people relying on you to do it.
Can you not draw up some sort of action plan after each meeting assigning tasks to each person?

Like fuck i'd do that.
That's why you have managing agents for properties.

Only 5 flats in the building, cost of a managing agent is very expensive when only split across 5 places.

The problem with this is he gets the benefit of living in a well maintained building (we're doing a lot to the place this year - roof, repainting, new door security etc). There's a lot to organise & he'll get the benefit without helping out.

will excluding him from all decisions annoy him at least?
It may depend if you want revenge of for him to do his bit. if the former, exclude him from all decisions, then proceed to use his lweast favoutite pain colour, remove cycle racks and buy barbeques allround. if the latter, solicitors letter is probably the way to go and should be fairly cheap.

solicitor's letter then setting out his legal responsibilities and pray he's stupid enough to be scared of it.

yeah, but there's at least 2 kinds of idiot.
one type will be scared by the legal language and actually comply, the other will think he can win a protracted legal battle and embark on one.

but what legal responsibilities?
if he isn't part of the freeholder, provided he complies with the terms of his lease, then he IS complying with his legal responsibilities. there'd need to be something in his lease obliging him to do this kind of thing. if there is, then the freeholder is the only person who can make him do it. via the courts if he refuses.
i'm not saying he isn't an anti-social cunt.

We have articles of association for a residents association and a delegation of authority in place from the freeholder
Which as I understand it allows the RA to get work done without having to involve the freeholder (who would charge a fee to manage it).
The articles place equal responsibility on all residents to play an active role in the management of the maintenance of the building, in addition to paying their contribution.

that is very good for such a small block
if more people had such things, their lives would run more smoothly. then the best bet is to highlight his responsibilities in the agreement and say, either join in or we'll get legal on your ass.
