Building dust fiasco update: we were out of our house for 3 days. Cleaners spent a day cleaning, builders did more building, it got worse again. Got back in last night, had to stay upstairs as downstairs is all dust. Surveyor is in a stand off between contractors and freeholder, both of whom accept no blame and worse still, contractors are lying and saying they wanted to put plastic sheeting down for us but we refused. Fucking cunting liars.
Today they were working and there was fumes and dust and our smoke alarm went off and I was out on the street with the baby for 3 hours. More cleaners have just been but say it's going to get bad again as the dust settles. We have about £250 of laundry needing done (curtains, cushions, all the baby stuff that was on the landing and needs cleaning now) that the contractors and freeholder are refusing to pay for. I have a cough and feel rough. The baby is crying. It's snowing. Next stop solicitor (if we can get hold of him), then the local news.

yep, I'm sure. I've been through some fairly interesting insurance claims. That's certainly how it works with car insurance companies. I can't promise for household insurance but I can't see why it would be different.

Building insurance is arrange by the freeholder who is not being remotely understanding about this (but it ain't really a building insurance issue).

you won't lose no claims if you make a claim that isn't your fault. It's up to your insurance company to recover the costs from the party at fault. That's what insurance is for.

It's not compulsory to have PL insurance but any firm that doesn't is a cowboy operation.
If you claim through your Contents insurer that's the first question they'll ask, because they'll be wanting their outlay back off the builders.

To cause the problem initially is poor; to knowingly continue to do, without taking steps to contain the dust is quite outrageous.
I should ask them to immediately send you a copy of the risk assessment that they should have carried out before commencing works.

All works that result in hazardous waste, such as building/science, have to submit a Risk Assessment form that states what the risks are and how they're going to manage them. Usually they have to submit them to the council too if the work is going to be major (such as what is happening where you live).
Try asking the council for them if the guilty party refuses to show you the sheet, and if they haven't actually submitted one, they'll be in more trouble still.
At least, they would be if it was in aus. But you could try it anyway!
