he makes it sound like the jurors completely ignored all "prior art" but if you read the interview that he's referring to in full it's pretty clear that they said they got bogged down with the first device, along with it's supposed prior art, and moved on - only to go back to it later.
But yeah, it was always going to go to appeal whatever the outcome.

The majority would've been...

That reminds me of a something my parents saw in Florida last month
Some idiot was on a motorbike, weaving in and out of traffic. His bike
came into contact with pick-up truck and shattered. He flew through the
air like a rag doll and landed cleanly in the back of the pick-up. The
pick-up driver apparently didn't notice a damn thing, and would have carried
on driving, had the cyclist not been knocking on the back window.
That's as much as my parents saw. Being Florida, I imagine it all ends
with the cyclist being shot.
